These Terms of Service ("Terms") create a legal agreement between you and FLEX U.^® ("we," "us," "our"). By accessing our website, purchasing our programs, or using our services, you agree to be bound by these Terms, which are designed to ensure clarity, respect, and a positive experience for everyone in our global community. 

2. Our Role: Education and Empowerment

Our role is to provide you with high-quality educational content, coaching, and a community space. We train you on the Indie Ops Method™ through our intensive 2-Week Accelerator. All information shared is for educational and informational purposes only, offered as a perspective to assist you in your own personal and professional expansion.

4. Intellectual Property & Proprietary Information

• Ownership: All content, including course videos, worksheets, frameworks, and materials associated with the Indie Ops Method™, are the exclusive property of FLEX U.® and are protected by copyright, trademark, and other intellectual property laws. FLEX U.® is a registered trademark, and Indie Ops Method™ is a trademark of our company.

• Limited License for Clients: Upon purchase, we grant you a limited, non-transferable, non-exclusive license to access and use our program materials for your personal and professional development only. This license is for your individual use. You are expressly prohibited from sharing, copying, distributing, selling, or creating derivative works from our materials. Sharing your login credentials is a violation of these Terms and may result in immediate termination of your access without a refund and potential legal action.

5. Confidentiality of Exploratory Discussions & Idea Submission 

We are often engaged in conversations with individuals and organizations about potential partnerships, collaborations, or employment. We appreciate this interest, and in these discussions, we may share proprietary concepts, research findings, and outlines of our frameworks ("Confidential Information").

You agree that any Confidential Information shared by us during these exploratory discussions is for evaluation purposes only. This information remains the exclusive, confidential, and proprietary intellectual property of FLEX U.®. You may not use, reproduce, implement, or create derivative works from our Confidential Information for any purpose, commercial or otherwise, without entering into a formal, written licensing agreement with us. Acceptance of our ideas without compensation or credit is strictly prohibited.

6. Payments and Our 30-Day Guarantee

We offer clear and straightforward payment options. All payments are processed securely through a third-party payment processor.

30-Day Money-Back Guarantee: We are committed to helping you build the business you want and want you to feel confident in your decision to join our accelerator program. If you fully participate in the program and complete all the assignments as designed, but are not completely satisfied with the training, you can request a full refund within 30 days of your purchase. By providing a testimonial, you grant us a perpetual, worldwide, royalty-free license to use your name, likeness, and story in our marketing materials. We will always represent your experience truthfully and will not alter your words in a way that changes their meaning. We will never use your name or photo without your consent.

8. Consent for Participation and Content Creation

Our programs, including the 2-Week Accelerator, are interactive experiences where your contributions add value for the entire community.

Consent to Use Anonymized Contributions: By participating in our programs and submitting comments, questions, or other text-based contributions, you grant FLEX U.® the right to use this content in the creation of future products and marketing materials. You agree that we may use these contributions, or "quotes," in an anonymized format, without your name or any other personally identifying information, without further compensation to you. This allows us to share the value of our co-creation while respecting your privacy.

9. International Use and Data Privacy

We operate from Canada but serve clients globally. You agree to comply with all local laws and regulations regarding online conduct and acceptable content in your jurisdiction.

• Data Protection: Your privacy is important to us. We are committed to protecting your personal information in accordance with Canada's Personal Information Protection and Electronic Documents Act (PIPEDA). For our clients in the European Union and the United Kingdom, we also strive to be compliant with the General Data Protection Regulation (GDPR). 10. Limitation of Liability and Indemnification

By using our services, you agree that FLEX U.®, its directors, and its employees will not be held liable for any direct, indirect, incidental, or consequential damages resulting from your use of our website or participation in our programs. You agree to indemnify and hold us harmless from any claims, damages, or expenses, including legal fees, arising from your breach of these Terms.

• Governing Law and Jurisdiction: These Terms shall be governed by and construed in accordance with the laws of the Province of Ontario and the federal laws of Canada applicable therein. You irrevocably agree that the courts of Toronto, Ontario, will have exclusive jurisdiction to settle any dispute or claim that arises out of or in connection with these Terms. This does not prevent us from bringing proceedings against you for breach of these Terms in your country of residence or any other relevant country.
